Xorbia Technologies, Inc., operating as Big Tickets (“Big Tickets,” “we,” “us,” or “our”) provides an event ticketing platform and related services (“Services”) exclusively within the United States. This Privacy Policy (“Privacy Policy”) details our policies and practices regarding the collection and use of your personal information and sets forth your privacy rights. By using our Services, you agree to the collection and use of information as described in this Privacy Policy.

Policy Scope and Links to Other Websites

This Privacy Policy addresses activities on the Big Tickets platform, this website, and any other website or web-based system provided by Big Tickets (the “Website”). Through the Website you are able to access links to other websites which are not under the control of Big Tickets. We have no control over the nature, content, and availability of those sites. This Privacy Policy does not cover links within this Website that link to such other websites. We encourage you to read the privacy statements on any other websites you visit.

The Information We Collect and How We Use It

Big Tickets collects personal information about you in order to:

  1. identify you each time you visit our Website or wish to have a Service provided;
  2. process orders or applications submitted by you;
  3. send you transactional SMS or email notifications related to your order and event activity (where you have opted in);
  4. share your information with the event organizer to enable them to run the event and fulfill their obligations to you;
  5. improve our Services and Website;
  6. customize your experience; and
  7. carry out research on the demographics, interests, and behavior of our customers.

Depending on the Service, personal information we collect may include:

  • first name;
  • last name;
  • email address;
  • mobile phone number (when provided at checkout or waitlist registration);
  • IP address and device/browser information;
  • ticket purchase history and event preferences;
  • credit card number (processed securely by our payment processors); and
  • billing address.

For Big Tickets’s email and SMS communication purposes, the bases for lawful processing are:

  1. to the extent that you have given us consent;
  2. as necessary for the performance of a contract; or
  3. for the purposes of pursuing Big Tickets’s legitimate business interest.

Sensitive Personal Information

We will never use or disclose any sensitive personal information you provide to us except to provide you with the goods and services you have requested or for the limited purposes allowed under applicable law. Sensitive personal information includes payment card data, government identification numbers, and similar categories defined under applicable U.S. state privacy laws. We do not collect biometric data or precise geolocation data in connection with our ticketing services.

SMS Notifications from Big Tickets

Big Tickets sends transactional SMS notifications to customers who have explicitly opted in by checking an unchecked consent box at the time of checkout or waitlist registration. By opting in, you agree to receive SMS messages from Big Tickets related to your order and event activity, including:

  • order and ticket purchase confirmations;
  • ticket delivery notifications;
  • waitlist status updates (enrollment confirmation, ticket availability, waitlist expiration); and
  • payment failure alerts requiring customer action.

Message frequency: Message frequency varies based on your order and event activity (typically 1–4 messages per transaction).

Message and data rates: Message and data rates may apply based on your mobile carrier plan.

Opt-out: You may opt out of Big Tickets SMS notifications at any time by replying STOP to any message we send. You will receive one confirmation message and will not receive further SMS messages unless you opt in again.

No sharing of SMS consent: Big Tickets does not sell, share, or transfer your SMS opt-in data or consent to any third party for any purpose, except as may be required by law or as expressly authorized by you. This applies to all text messaging originator opt-in data and consent records.

Big Tickets does not use your mobile phone number for marketing or promotional SMS messages. All SMS messages sent by Big Tickets are transactional and directly related to a purchase, waitlist request, or other action you initiated.

SMS Notifications from Event Organizers

At checkout, you may separately be offered the option to receive SMS communications from the event organizer for the specific event you are purchasing tickets for. This consent is separate from the Big Tickets SMS program described above and is governed by the organizer’s own privacy and messaging practices. If you opt in, your mobile phone number will be shared with the named event organizer solely for their event-related communications. Big Tickets is not responsible for the content, frequency, or practices of event organizer SMS programs. To opt out of organizer messages, reply STOP to any message received from the organizer.

Event Partners — How We Share Your Information

When you purchase a ticket, Big Tickets shares your information with the event organizer (the venue, promoter, or other entity running the event) as necessary to fulfill the event, allocate tickets, and communicate important event information such as schedule changes, cancellations, or venue instructions. We identify the event organizer on the event page and checkout flow so you know who will receive your information at the time of purchase.

Event organizers receive your name, email address, ticket order details, and (where you have separately consented) your phone number. Event organizers’ use of your information is governed by their own privacy policies. We encourage you to review the privacy policy of any event organizer whose event you attend.

Data Retention

Big Tickets retains personal information for as long as necessary to provide the Services and fulfill the purposes described in this Privacy Policy, unless a longer retention period is required by law. Specifically:

  • Transaction records are retained for seven (7) years to comply with applicable tax and financial recordkeeping requirements.
  • SMS consent records are retained for a minimum of four (4) years.
  • Account data is retained for as long as your account remains active or as needed to provide Services. We may delete or anonymize account data after an extended period of inactivity.

Please note that if you have a ticket for an upcoming event, we cannot delete your account or order records until after the event has taken place, as doing so would prevent your event access. Once the event has passed, you may request deletion as described in the Individual Rights section below. When deletion is requested and approved, we will complete deletion within 90 days.

Aggregated Service Data

In an ongoing effort to better understand and serve our customers, Big Tickets may conduct research on customer demographics, interests, and behavior based on the personal information and other information provided to us. This research may be compiled and analyzed on an aggregate basis, and Big Tickets may share this aggregate data with its affiliates, agents, and business partners. This aggregate information does not identify you personally and is not considered personal information.

Through the Big Tickets Website

As is true of most other websites, the Website collects certain information automatically and stores it in log files. The information may include (i) internet protocol (“IP”) addresses, (ii) the region or general location where your computer or device is accessing the internet, (iii) browser and system information, and (iv) other actions performed by you on the Website. We use this information to help us design our Website to better suit our users’ needs. We may also use your IP address to help diagnose problems with our server and to administer our Website, analyze trends, track visitor movements, and gather broad demographic information that assists us in identifying visitor preferences.

The Website also uses cookies. Cookies are small text files that are placed on your computer by websites that you visit. They are widely used in order to make websites work, or work more efficiently, as well as to provide information to the owners of the site. Most web browsers automatically accept cookies. If you prefer, you may change your browser’s settings so that it will not automatically accept cookies. If you set your browser’s settings to block cookies, you may not be able to take full advantage of the Website.

Do Not Track: Our Website is not currently designed to respond to browser-level “Do Not Track” signals. However, our Website does recognize Global Privacy Control (“GPC”) signals. If we detect that your browser is communicating a GPC signal, we will process that as a request to opt your browser and device out of any sale or sharing of personal information via cookies and tracking tools on our website.

Third-Party Service Providers

We work with third-party service providers who perform services on our behalf, including payment processing, SMS message delivery, email delivery, fraud prevention, and web analytics. These providers are given access to the personal information needed to perform their functions and are not permitted to use it for any other purpose. Categories of third-party service providers include:

  • payment processors (who process credit card and other payment transactions securely on our behalf);
  • SMS and communication providers (who deliver transactional messages you have opted into);
  • fraud prevention providers (who help us detect and prevent fraudulent transactions); and
  • website hosting and analytics providers.

Our Service also allows you to integrate with various online third-party services (“Third-Party Services”). When you enable linking between Third-Party Services through the Service, we collect relevant information necessary to enable the Service to access that Third-Party Service. We store any Login Credentials in an encrypted format. The manner in which Third-Party Services use, store, and disclose your information is governed by the policies of those Third-Party Services, and Big Tickets shall have no liability or responsibility for their privacy practices.

When and How We Share Information with Others

We share personal information in the following circumstances:

  • Event organizers: As described above, we share your name, email, and order information with the event organizer to fulfill the event. If you separately opt in, we also share your phone number with the organizer for their SMS communications.
  • Third-party service providers: We share information with service providers who help us operate our platform, process payments, deliver messages, and prevent fraud, solely for those purposes.
  • Legal requirements: We may share information in response to a lawful request by law enforcement or other government officials relating to a criminal investigation or alleged illegal activity, or as otherwise required by law.
  • Business transfers: In the event of a merger, acquisition, or sale of all or substantially all of our assets, customer information may be transferred to the acquiring entity. We will notify you of any such change in ownership or control of your personal information.
  • With your consent: We may share your information with other third parties when you give us your explicit consent to do so.

Do Not Sell or Share My Personal Information

Big Tickets does not sell your personal information to third parties for monetary consideration. Big Tickets does not share your personal information with third parties for cross-context behavioral advertising or targeted advertising purposes.   • Right to Opt Out: Request to opt out of the sale or sharing of your personal information. As stated above, Big Tickets does not sell or share personal information for advertising purposes.
  • Right to Non-Discrimination: We will not discriminate against you for exercising any of your privacy rights.

How to Submit a Privacy Rights Request

To exercise any of the above rights, please contact us at support@bigtickets.com with the subject line “Privacy Rights Request,” or write to us at the address below. Please include your full name and the email address associated with your account so we can locate your information.

Identity verification: To protect your information, we will verify your identity before processing your request. Verification typically requires that you confirm your full name and the email address associated with your account. For sensitive requests, we may require additional information. We may also send you a confirmation email that you must respond to before we process your request.

Authorized agents: You may designate an authorized agent to submit privacy rights requests on your behalf. To use an authorized agent, you must provide either (a) a signed written authorization designating the agent, or (b) a valid power of attorney. We may follow up directly with you to verify the agent’s authorization before processing the request.

Response time: We will respond to verifiable requests within 45 days as required by applicable law. If we require additional time, we will notify you.

Appeals: If we deny your privacy rights request in whole or in part, you may appeal by contacting us at support@bigtickets.com with the subject line “Privacy Rights Appeal.” We will respond to your appeal within 60 days.

California Residents — Additional Rights (CCPA / CPRA)

California residents have all of the rights described in the Individual Rights section above. In addition:

  • Shine the Light: California residents may request information about our disclosures of personal information to third parties for their direct marketing purposes during the prior calendar year. To submit a Shine the Light request, contact us at support@bigtickets.com with the subject line “Shine the Light Request.” This service is provided free of charge.
  • Sensitive Personal Information: California residents have the right to limit the use and disclosure of sensitive personal information to what is necessary to perform the services you requested. We do not use sensitive personal information for any purpose beyond providing our Services.

Nevada Residents

If you are a Nevada resident, you have the right to opt out of the sale of certain covered information. As stated above, Big Tickets does not sell personal information. If you have questions, please contact us at support@bigtickets.com.

Other U.S. State Privacy Rights

Residents of Virginia (VCDPA), Colorado (CPA), Connecticut (CTDPA), Texas (TDPSA), Oregon (OCPA), Minnesota (MCDPA), and other states that have enacted comprehensive consumer privacy legislation have rights similar to those described in this policy, including rights to access, correct, delete, appeal, and opt out of certain processing of personal data. To exercise any applicable state privacy rights, please contact us at support@bigtickets.com. We will respond within the timeframe required by your state’s applicable law.

Your Choices About Your Information

You can contact us directly at support@bigtickets.com to review, correct, or request deletion of the information that Big Tickets keeps on file, or to change your notification preferences. To opt out of Big Tickets SMS notifications, reply STOP to any message we send you.

Security of Your Information

We maintain physical, technical, and administrative safeguards to protect your information. When you submit sensitive information via the Website, your information is protected both online and offline. Wherever we collect sensitive information (such as credit card data), that information is encrypted and transmitted to us in a secure way. You can verify this by looking for a lock icon in the address bar and looking for “https” at the beginning of the address of the Website.

Only employees who need access to the information to perform a specific job function (for example, billing or customer service) are granted access to personal information. We commit to taking appropriate disciplinary measures to enforce our employees’ privacy responsibilities.

Compromise of Personal Information

In the event that personal information is compromised as a result of a breach of security, Big Tickets will promptly notify those persons whose personal information has been compromised in accordance with the notification procedures set forth in this Privacy Policy and as required by applicable U.S. state breach notification laws.

Children

Big Tickets does not knowingly collect personal information from children under the age of 13. If you are under the age of 13, please do not submit any personal information through the Services. If you have reason to believe that a child under the age of 13 has provided personal information to Big Tickets through the Services, please contact us, and we will endeavor to delete that information from our databases.

Notification Procedures

It is our policy to provide notifications, whether such notifications are required by law or are for business-related purposes, to you by (i) email notice, (ii) written or hard copy notice, or (iii) through conspicuous posting of such notice on the Website, as determined by Big Tickets in its sole discretion. We reserve the right to determine the form and means of providing notifications to you, provided that you may opt out of certain means of notification as described in this Privacy Policy.

Changes and Updates to the Privacy Policy

Big Tickets reserves the right to amend this Privacy Policy at any time, for any reason. Changes to this Privacy Policy are effective when they are posted on this page. When we make material changes to this policy, we will update the “Last Updated” date at the top of this page and, where required by law, notify you directly.
